During the session on Tuesday, the 3rd, the president of the 6th panel of the STJ, Minister Sebastião Reis Jr., harshly criticized the use of police approaches based exclusively on the nervousness of suspects. The debate took place during the trial that discussed the legality of a personal search based on this justification.

To illustrate his concern about police performance, the minister mentioned two recent episodes that occurred in São Paulo.

He cited the case of a man who had been held hostage and, in the early hours of last Monday, the 2nd, was thrown by a military police officer from a bridge into a stream, in Cidade Ademar, in the south of São Paulo.

The minister also commented on the case of a plainclothes police officer who fired 11 shots in the back at a man suspected of stealing cleaning products from a supermarket. Images show the suspect slipping as he tried to leave the scene, at which point the off-duty police officer drew his gun and fired the shots.  The incident occurred on November 3, in the South Zone of the capital of São Paulo, and was recorded by security cameras.

In a scenario like this, wanting citizens to not feel fear or discomfort when faced with police authorities is ignoring the facts , he concluded.

In a statement , the Public Ministry of São Paulo spoke out about the case of the military police officer who threw a man off a bridge.

Shocking and absolutely unacceptable! There is no other way to classify the images of the moment in which a military police officer throws a man from the top of a bridge, this Monday. From the footage released by the press, it is clear that the suspect was already under control by the security agents, who had the functional duty to take him, intact, to a police station so that the occurrence could be recorded. Public safety is only achieved within the limits of the law, never outside them. Therefore, this Attorney General's Office will determine, still this Tuesday (12/3), that the Special Public Safety Task Force (GAESP) join forces with the natural prosecutor of the case so that the MPSP makes every effort to punish, in an exemplary manner, at the end of the criminal prosecution, those responsible for a police intervention that is far from reassuring the population. On the contrary. The recurring episodes of non-compliance with legal orders by some public agents take us further away from the much-desired social peace, in favor of which the Public Prosecutor's Office, within its attributions, to exercise external control over police activity, will continue to act unequivocally, demanding that the authorities observe the precepts of the Federal Constitution.

The Secretary of Public Security of São Paulo, Guilherme Derrite,  announced, in a video published on X, the immediate removal of the police officers involved in an episode that he described as regrettable.

According to Derrite, the mission of the Military Police differs greatly from this type of attitude. The officers were sent to serve time at the PM's Internal Affairs Department while the facts are investigated.
