A heated debate between Judge Ana Maria Almeida Vieira, from the 6th Public Treasury Court of the TJ/MA, and lawyer  Ruth Rodrigues  took place this week during a virtual hearing in a case of obstetric violence. The lawyer wanted the transcription of a medical report because she was ineligible, and the judge showed irritation with the request, generating discussion.

Gosh, I'm wasting my time, I could be doing so many things, said the judge when she didn't notice the camera and audio were on.

The episode occurred after the lawyer requested to transcribe a report that, according to her, was illegible and had parts impossible to understand.

The judge then said that the lawyer would have five days to make the request in writing and she would give the parties a chance to see if it would be possible. The lawyer then said that she would like to make the request orally so as not to prolong the process, a request that was denied by the judge.

That's when the discussion started.

-  I will give you five days to formalize your request because I already know what will happen. The parties will speak out and we will decide later , said the judge.

- It's not a matter of visualization, it's the patient's right to have their medical records transcribed. I'm shocked at how the transcription of a medical record, a simple thing that I request in all cases, is causing all this fuss in this hearing , the lawyer said indignantly.

- The lady who has been causing this fuss since the hearing began is because she is not behaving appropriately. I will conduct this hearing correctly and will give you five days to make your request. The hearing is now closed , concluded the judge.

At this point, the judge, thinking that the camera and audio had already been turned off, said:  Wow, I'm wasting my time, I could be doing so many things .

We have to fight

In a post on social media after the episode, the lawyer said that I have never been so mistreated in 18 years of practicing law.

I defend my client's rights and I don't have a favorite judge. I don't accept and will not accept certain situations. According to the constitution, there is no hierarchy between judge, lawyer and attorney. In practice, we have to fight.
