Judge Ana Paula Viana Silva de Freitas, from the 3rd Criminal Court of Caruaru/PE, prohibited two brothers who were victims of racism from speaking out on social media about what happened or criticizing the conduct of the criminal proceedings against the aggressor.
According to the judge, the decision is to avoid the intensification of the conflict and the defamation of the image of the Justice system.
Understand the case
Two brothers, who live in Caruaru/PE, filed a lawsuit against their neighbor for making racist insults against their families, using terms such as "bunch of monkeys", "family of monkeys" and "after these monkeys came to live here, I have no peace anymore".
According to the victims, the suspect also threw dog feces at the family's residence, as well as bananas, stones, sticks, bottles and bricks that hit the victims' roof and yard.
She even threatened to set the family car on fire. Among the victims was a 72-year-old woman whose health deteriorated as a result of these attacks.
The case was tried by Judge Carla de Rego , of the 4th Criminal Court of Caruaru/PE and the accused was sentenced to ten years and six months in prison and one month in detention for racism.
Judge banned victims of racism from speaking out on social media about the criminal case against the attacker.
Court decision
After the attacker was convicted, the Public Prosecutor's Office requested a secrecy decree in another case, in order to avoid new conflicts between the parties and the spread on social media.
In accepting the MP's request, Judge Ana Paula stated that "the parties have harbored animosity for a long time, and the dissemination of facts on social media only intensifies the conflict and unjustifiably denigrates the image of the justice system."
"The facts are under investigation, and there is no justification or basis for the parties to be prevented from posting any comment authorized by the public authority in the performance of their duties."
Therefore, in addition to determining confidentiality, the judge ordered the parties to remove any previous posts related to the case.
"The parties are hereby ordered to remove any previous posts that are still available on social media, as well as to refrain from making new posts or any comments on the facts under trial in these proceedings, or from using materials for third parties to make comments freely on social media."
The process is under judicial secrecy.
