Judge Paulo Henrique Stahlberg Natal, of the 4th Civil Court of Limeira/SP, ordered the seizure of 50% of the wedding gifts received by a debtor through the "Casar.com" platform. The measure was adopted to guarantee the payment of an outstanding debt, given that the defendant, despite having a high financial standard, did not fulfill his judicial obligations.

 

The process, which has been going on for more than five years, involved unsuccessful attempts to locate and block the debtor's assets through systems such as Sis. Due to the ineffectiveness of these actions and the defendant's failure to comply with court agreements, the judge had initially authorized the seizure of wedding gifts, in addition to atypical measures such as blocking credit cards and suspending the debtor's driver's license and passport.

 

However, with the allocation of Theme 1,137 by the STJ, which determined the suspension of proceedings that deal with the adoption of atypical executive measures throughout the national territory, the judge decided to suspend these restrictions, maintaining exclusively the seizure of credits obtained on the "Casar.com" platform. The main objective is to ensure the satisfaction of the debt, which totals R$856,045.27, until the STJ concludes the IRDR judgment on the subject.

 

There is no reason to allege a lack of proportionality in this measure, since the debtor's conduct constitutes a true attack on justice, as he maintains excessive expenses and a high standard of living, deliberately failing to fulfill his obligations to the courts. What we have, therefore, is an attempt to evade his creditors and hide his assets, since he does not even have money in a bank account, which was demonstrated by the various requests for blocking via SISBAJUD requested by the Plaintiff, said the judge.
