The Brazilian justice system now has a standardized summary model to be used in rulings issued by the country's courts. The initiative aims to create an objective structure that facilitates the quick and clear understanding of the main points and grounds of judicial decisions, benefiting the parties involved, the legal community and the general public.
The recommendation, approved on Tuesday, the 13th, during the 9th regular session of the CNJ, was prepared jointly by the presidency and the ombudsman's office. "It is not uncommon for the summaries to be excessively long and use language that is not very accessible, which makes it difficult to understand the decisions and compromises compliance with the Judiciary Pact for Plain Language," stated Minister Luís Roberto Barroso, president of the CNJ and the STF.

The summary, which is the part of the court ruling that summarizes the decision taken, should follow a pattern that includes five essential elements: a succinct heading; a summary of the case analyzed; a clear identification of the issues under discussion; the proposed solution; and the provision or thesis, which summarizes the conclusion of the judgment. Finally, the summary should list the relevant legislation and case law.
In addition to improving the understanding of judicial decisions, standardization also favors the application of case law and the functioning of the precedent system, as established by the CPC .
Another benefit of standardization is the optimization of the processing and analysis of information from judgments by Artificial Intelligence systems, which help in the rapid and accurate recovery of relevant data.
