On Wednesday, the 7th, the Supreme Court will judge the declaration of appeal filed by the newspaper de Pernambuco SA

 

The newspaper requests clarification regarding the thesis that defined exceptional situations in which journalistic companies may be ordered to pay compensation for the publication of interviews that falsely attribute the practice of a crime to another person  ( RE 1,075,412 ) .

Another case discussed is the one that discusses the competence of the TCEs to judge the financial statements of mayors.

 

In this action,  - Association of Members of the Courts of Auditors of Brazil argues that judicial decisions have prevented judgments of management accounts carried out by the TCEs from generating electoral effects and the application of fines and compensation to the public treasury ( ADPF 982 ). 

 

The resumption of the trial of HC 185,913 is also planned , with a casting vote by Minister André  It discusses the retroactivity of the ANPP - non-prosecution agreement.

 

The last item on the agenda is RE 1,301,250 , which addresses the limits of the judicial decree of breaking the confidentiality of telematic data in criminal investigations involving undetermined people.

 

In this case, with recognized general repercussions, Google questions a decision by the STJ that admitted the breach of confidentiality of data from people who carried out research on councilwoman Marielle Franco before her murder in 2018. In 2023, the then rapporteur, Minister Rosa Weber (now retired)  voted against handing over the data.

 

STF will analyze appeals in case of press liability and blood transfusions to Jehovah's Witnesses in the SUS. 

On Thursday, the 8th, the agenda will be dedicated to the presentation of the report and the carrying out of oral arguments in actions that discuss blood transfusion and religion.

 

In  RE 1,212,272 , the Supreme Court must define whether  Jehovah's Witnesses can refuse blood transfusions in the SUS. In  RE 979,742 , the Court analyzes whether  the Union must pay for alternative procedures to transfusions in the public health system.

 

The analysis of ADIN 7,416 is scheduled for the same session , in which the Brazilian Association of Internet and Telecommunications Providers questions the law of Mato Grosso do Sul that requires the specification, in internet bills, of the daily amount of speed for receiving and sending data.

 

Another scheduled trial is that of ADIN 5,254 , which discusses whether the Pará Public Accounts Office has administrative and financial autonomy.
