The CCJ - Constitution and Justice Committee of the Chamber of Deputies put on the agenda, on Friday, the 5th, the vote on PL 212/24 , which includes in the Penal Code the classification of qualified homicide against lawyers. The proposal, authored by state deputy Carvalho, establishes a special cause for increasing the sentence when the injury is caused against the professional in the exercise of his/her function or as a result thereof.
The committee, chaired by deputy Caroline de Toni, should analyze the text this week.
The acting president of CFOAB, Rafael Horn, considered it especially important that the bill be included on the CCJ's agenda on the day that the former president of OAB/MT, Renato Gomes Nery, was shot as he arrived at his office in Cuiabá/MT. "The attack on our colleague Renato Gomes Nery is a regrettable reminder of the vulnerability of lawyers in the exercise of their profession. The bill's inclusion on the CCJ's agenda is an urgent and necessary response to reinforce the protection of those who defend citizens' rights and justice ," he declared.
The project is expected to be analyzed by the Chamber's CCJ this week.
According to Horn, the approval of the bill would also represent an important step towards moving other proposals forward. This is the case of Bill 5.154/23, which proposes the immediate granting of protective measures to lawyers who are assaulted while practicing their profession, presented by the CFOAB last year. The suggestion was put into practice after a lawyer from Santa Catarina was assaulted by a client's ex-wife while she was in a café in SC, and received 12 stitches in her head.
"The granting of protective measures ensures that the lawyer who has been attacked can continue to practice his or her profession, contributing to the reduction of anguish, the increase of safety, the prevention of the recurrence of the aggression and, ultimately, guaranteeing his or her own life. With the approval of this law, we hope for the rapid and effective implementation of protective measures for the benefit of colleagues who have been attacked, strengthening the defense of professional prerogatives" , added Rafael Horn.
According to the report by the rapporteur of Bill 212/24, Congressman Ricardo Ayres, Brazilians have witnessed an exponential increase in the number of homicides and bodily harm crimes against lawyers, whether in the exercise of their duties or as a result of them. "Considering that the offender's behavior directly affects the proper functioning of the state's justice system, affronting the established powers, it is essential to make homicide aggravated, as well as to include a reason for increasing the sentence for the crime of intentional bodily harm" , states the text.
After being examined by the CCJ, the agenda will be forwarded for deliberation by the plenary of the Chamber of Deputies.
