Condominium will compensate resident after releasing video of marital fight

Repairs were increased to R$8,000.

 

The 28th Chamber of Private Law of the TJ/SP upheld the condominium's condemnation to pay compensation for moral damages to a woman who had a video of a marital fight in the elevator leaked. The repair value, initially set at R$5,000, was increased to R$8,000. In the first instance, the case was judged by the 10th Civil Court of Guarulhos, with a sentence handed down by Judge Lincoln Antônio Andrade de Moura.

 

According to the records, images from cameras installed in the condominium's elevator, in which the author appears fighting with her ex-partner, were shared in message exchange groups, achieving wide dissemination.

 

 

The fight between the couple occurred in the condominium elevator.

For the rapporteur of the appeal, judge Dimas Rubens Fonseca, the defendant's responsibility for keeping the videos generated by his internal monitoring system is uncontroversial, "and he must be held responsible for the leak of content that causes damage to the personality rights of those involved".

 

"Considering the circumstances of the case, the economic conditions of the parties, the objective severity of the damage and its harmful effect, the fixed amount of compensation for moral damage must be increased to R$8,000" , he wrote.
