1st class denied appeal by  dos Reis, target of disciplinary complaint for alleged violations of functional duties.

 

Unanimously, the 1st panel of the STF confirmed the CNJ's decision to open a disciplinary complaint against judge  dos Reis, from the TRF of the 6th region.

 

In the virtual session that ended on May 24, the collegiate followed the vote of minister Cristiano  , rapporteur of the case, who had denied MS 39,543, in which the judge requested the annulment of the CNJ's decision.

 

When analyzing the appeal against his individual decision, the minister observed that the arguments presented by the magistrate's defense were the same as those previously rejected, without bringing any new element capable of changing the decision. Among the allegations were the alleged inconsistency in the evidence and facts that led to the initiation of the procedure, as well as the restriction of defense.

 

According to , there was no illegality or abuse in the procedure.

Slowness

 

dos Reis is the target of an investigation by the CNJ for alleged violations of functional duties. To the STF, the CNJ reported having received complaints of misconduct attributed to the judge, such as poor management and slowness in processes, inadequate relationships with civil servants and inaccuracies regarding the magistrate's residence address, who did not reside in Minas Gerais. TRF-6 is based in Belo Horizonte.

 

In February of this year, the Council ordered the opening of the administrative disciplinary process and removed the judge from his position.

CNJ will investigate judge for “protracted and explosive” conduct

Slowness in conducting processes and lack of urbanity motivate investigation of the magistrate's conduct.

 

This Friday, the 6th, the National Justice Inspectorate filed a disciplinary complaint against judge dos Reis, from the TRF of the 6th Region, to investigate alleged violations of functional duties. 

 

In addition to problems in case management, an extraordinary correction carried out in the magistrate's office, in August 2023, found reprehensible conduct in dealing with civil servants and other court judges.

 

In the decision, the national inspector of justice, minister Luis Felipe , highlighted excessive delays in the conduct of processes, a high number of judgments pending signature and constant postponements of trials. 

 

Regarding the treatment given by the Federal judge to civil servants, there are reports of the judge's "explosive" temperament, the exhausting pressure for results and long working hours, which often extended into the early hours of the morning.

In addition to the civil servants, even judges made complaints regarding the behavior of  dos Reis. According to his colleagues, it is common for him not to respect deadlines for making votes available and to excessively request a view of the processes being analyzed in court.

 

" The integrity of the magistrate's conduct, even in his private life, contributes to the formation of citizens' trust in the judiciary, therefore imposing on him restrictions and behavioral requirements different from those reserved for citizens in general. This, in fact, is the commandment provided for in articles 15 and 16 of the code of ethics of the national judiciary, based directly on the Constitutional text ", said Minister .

 

Another fact highlighted by the national inspector were episodes that occurred at /MG International Airport. An investigation was opened by the Federal Police Regional Inspectorate to investigate the judge's conduct for "violation of the legal duty to treat people politely ".

 

Finally, the National Inspectorate registers the need to investigate inaccuracies regarding the residential address information of the magistrate who, supposedly, does not reside in the state of Minas Gerais, where the TRF of the 6th region is located.
