The Federal Council of the OAB filed a request with the presidency of the CNJ to suspend the parties' ability to access subpoenas sent to lawyers constituted through the  EJD -  Electronic Judicial Domicile.

The request was presented by the president of OAB/PR, Winter, during the College of Presidents of OAB Sections, held in /AL, on April 26th

The national president of the OAB,  Simonetti, highlighted the concern of national lawyers with the possibility of deadlines being opened by the parties.

"This is because, the way the system currently operates, it is possible for the legal entity to open the subpoena, even in processes with a designated attorney, or when there is an express request in the file for subpoenas to be issued exclusively in the name of the specific lawyer, disrespecting § 5 of art. 272", considered Simonetti.

"In other words, the party can inform the summons sent to the appointed lawyer without his knowledge, which can lead to procedural inertia and loss of deadline, for example, generating procedural disruptions and harming effective judicial delivery", he warned.

DJE is a free digital platform that facilitates and speeds up consultations on summonses, subpoenas and other procedural communications sent by Brazilian courts.
