MP/SP calls for conviction of journalist persecuted by Carla

The process involves a discussion that took place in 2022 and an opinion article published on  internet by the journalist.

 

 

The MP/SP asked the Court to sentence journalist Luan Araújo  for the crimes of insult and defamation against Federal Deputy Carla Zambelli .

 

The journalist was chased in 2022, when the deputy ran after him with a gun through the streets of São Paulo, after a political discussion, on the eve of the second round of the presidential elections.

 

After the episode, the journalist published a column about the conflict, saying  maintains a sect of extreme right-wing patients " and that he " continues to commit atrocities ". In another excerpt, he states that Carla Zambelli is part of a " petty, malicious extreme right that is a merchant of death ". 

 

Due to the text, the deputy filed a criminal complaint against Luan, and the MP was against the process. Now, in a change of position, prosecutor  Roberto   has added an opinion opposing the journalist. 

 

 

 

MP/SP defends the conviction of journalist Luan Araújo threatened with a gun .

Lawyer Renan , who represents Luan, states that there is no new fact. She told the  newspaper that she was shocked by the MP's position. " This is a second persecution against Luan. He was already persecuted with a firearm. Now, he is legally persecuted. "

 

The column published by the journalist was removed by court order, pending the conclusion of the process.

 

MP's opinion

 

In the opinion, the prosecutor states that " from the beginning of the disagreement, there was a gratuitous and intentional offense against the deputy" .   after the first attack, Luan attacked the parliamentarian again in a "text based on the retaliatory and offensive ideal, in the face of a particularly experienced situation, and it cannot be admitted that the defendant was in these conditions, under the cloak of journalistic immunity for offend the victim in an unreasonable way".

 

Furthermore, the parquet member says that there was excessive language in the journalistic article, as "these are accusations that, in theory, harm the subjective and objective honor of the complainant and, therefore, at this procedural moment, exceed the limits of narration criticism regarding a disagreement that occurred between the parties".

 

In court, Luan Araújo defended himself, claiming that he did not commit any crime with the publication of the article and that he only carried out his professional work, protected by freedom of expression.

 

The case has not yet been judged.

 

Remember the episode

 

On October 29, 2022, Federal Deputy Carla  a Bolsonaro supporter, pulled out a gun and ran after a black man in São Paulo. 

 

In the video, it is possible to see people running and the deputy with a gun in hand, shouting, ordering the man to lie down on the ground. The situation escalated when the military police officer accompanying the deputy fired his weapon. Forensics later determined that the shooting was accidental.

 

The deputy defended her actions by claiming that she was acting in "defense of honor" and claimed to have been pushed by the man, an allegation contradicted by videos recorded by people who witnessed and recorded the event.
