Judge Helena Batista, from the 1st business court of Belo Horizonte/MG, decided to suspend the judicial recovery of the 123 group.

 

In the decision, the judge also determined that the resumption of the process will await a decision, in the second instance, regarding the prior finding of remaining companies. According to her, the measure aims to ensure compliance with legal deadlines.

 

The judge also noted the lack of a definitive decision regarding the professionals who will act as judicial administrators in the present case.

The judge clarified that in August 2023 the request for judicial recovery of three companies in the group was granted. Subsequently, two other companies, together with the others, requested their inclusion in the procedure. In October, a preliminary finding was determined in relation to these companies, a procedure designed to verify their effective functioning.

 

The preliminary verification process for the first three companies was completed, with judicial approval for the continuation of the process in relation to them. However, there has not yet been a second instance decision on the procedure of the other two companies.
