Unanimously, the National Council of Justice (CNJ) approved this Tuesday (14/11) a resolution that creates the National Judicial Examination. The test will be mandatory for candidates who wish to enter the judicial career. According to a statement from the council, the resolution seeks to democratize access to the judiciary career, in order to “privilege reasoning, problem solving and the vocation for the judiciary”.
Competitions already in progress will not be affected. However, the publication of new notices will be suspended after the publication of the resolution. The test will be administered by the National School for Training and Improvement of Magistrates , under the supervision of the CNJ.
“I am very happy with the approval of the National Judicial Exam, an idea that I have supported for a long time. We are going to standardize the level of knowledge of magistrates, we are going to better assess vocations and eliminate any insinuations of favoritism that, fairly or unfairly, appeared here and there”, stated the president of the CNJ, minister Luís Roberto Barroso.
According to Barroso, the test is only a prior qualification exam and does not remove the jurisdiction of the courts to hold their own competitions: “Proof of passing the national exam is a requirement for registration in these competitions”, explained Barroso.
The exam will have an objective test with an eliminatory nature only and will be held at least once a year, simultaneously in the capitals of all states and in the Federal District. Proof of approval will be valid for two years from the publication of the result.
The objective test will have 50 questions. There will be eight on Constitutional Law, and six questions each on the following themes: Administrative Law, general notions of Law and Humanistic Training, Human Rights, Civil Procedural Law, Civil Law, Business Law and Criminal Law.
Candidates who answer at least 70% of the questions in the objective test will be approved, or, in the case of self-declared black or indigenous candidates, 50%.
